T&Cs - General Terms and Conditions
These General Terms and Conditions govern the rights and obligations in connection with the use of the services offered on the platform www.chakratribe.one.
1 Introduction
1.1 Scope
These T&Cs of ChakraTribe, Rosie Rüesch, Morgentalstrasse 24, 8355 Aadorf, Switzerland (hereinafter "ChakraTribe"), as well as the provisions declared binding by it, in particular the Privacy Policy and the Price List, govern the use of the website www.chakratribe.one including all subdomains (hereinafter "Platform"). They apply to the contractual relationship between ChakraTribe and all users of the platform.
1.2 Amendments to these T&Cs
ChakraTribe may amend these T&Cs at any time and will publish the current version on the platform. Providers will be notified of changes by email at least 15 days before they take effect. Anyone who does not agree with a change may cancel their subscription before it takes effect. For bookings, the version valid at the time of booking applies.
1.3 The Platform
ChakraTribe operates an online platform where providers can showcase retreats, courses, workshops, online courses, and related offerings in the fields of yoga, meditation, mindfulness, and holistic well-being worldwide. Interested parties can find, compare, and book or inquire about these offers.
For the sake of simplicity, these T&Cs refer to the person or company publishing an offer as the "Provider," the person booking an offer as the "Participant," and the conclusion of a contract for an offer as a "Booking."
1.4 Legal Status of ChakraTribe
ChakraTribe provides only the technical platform. Contracts for participation in offers are concluded exclusively between providers and participants. ChakraTribe is not a party to these contracts and, in particular, does not act as an organizer, tour operator, or travel agent. The execution of the offers is the sole responsibility of the providers.
ChakraTribe is entitled, but not obligated, to verify the accuracy or legality of offers, texts, images, qualification details, and reviews.
1.5 No Right to Use
There is no entitlement to registration or use of the platform. ChakraTribe may refuse registration or suspend or close an account in accordance with Section 3.4.
2 Definitions and Types of Offers
2.1 Users
Users are all individuals who use the platform, in particular providers and participants.
2.2 Offering
An offering is a presentation of an event or service created by providers on the platform under their own responsibility.
2.3 Types of offerings
The following types of offerings are currently available:
a) Retreats: multi-day events held domestically or abroad, potentially including accommodation, meals, and a supporting program.
b) On-site events, courses, and workshops: one-time or recurring events held at a specific location.
c) Online courses and live sessions: offerings conducted via the internet, either live or as recordings.
d) Training and further education: e.g., yoga teacher training, including combinations of in-person and online modules.
3 Registration and user account
3.1 Purpose
Registration is intended exclusively for ChakraTribe partners (providers). A partner account and an active subscription (Section 6) are required to publish listings. Seekers and participants do not need an account or registration; bookings are made directly with the providers. The partner account is personal and non-transferable.
3.2 Requirements
Registration is open only to legally competent individuals aged 18 and over, as well as legal entities.
Registration details must be complete, accurate, and kept up to date. Providers must also provide their full name or company name, business address, contact person, telephone number, email address, and website, if applicable. ChakraTribe may verify this information and publish the legally required provider details alongside their listings.
The username must not be offensive or infringe upon the rights of third parties.
3.3 Providers based abroad
Providers residing or based outside of Switzerland are permitted. ChakraTribe may request additional documentation (e.g., proof of identity).
3.4 Commencement and termination
Start date: The usage agreement begins upon confirmation of registration via email.
Termination by users: Partners may delete their account at any time. Providers must terminate in accordance with section 6.3; outstanding amounts remain due. Seekers do not require an account.
Termination by ChakraTribe: ChakraTribe may suspend or close an account for objective reasons, particularly in the event of violations of these Terms and Conditions. For providers, termination is subject to a 30-day notice period and the provision of reasons. In the event of serious or repeated violations, reasonable suspicion of illegal conduct, or if required by legal obligations, ChakraTribe may suspend an account immediately. In such cases, the reasons will be communicated subsequently.
Reviews remain visible on the platform after an account is terminated. Excluded users may not register again without prior consent from ChakraTribe, neither under their own name nor under another name. Violations will be charged a fee of EUR 100.00.
4 Obligations of all users
4.1 Access credentials
Passwords and access credentials must be kept secret and must not be made accessible to third parties.
4.2 Technical interference
The use of mechanisms, software, or scripts that disrupt the operation of the platform or place an excessive burden on its infrastructure is prohibited. It is also prohibited to block or modify content generated by ChakraTribe or to otherwise interfere with the platform.
4.3 Personal rights of third parties
Content that users publish or communicate via the platform must not violate the personal rights of third parties and, in particular, must not be offensive, obscene, defamatory, harassing, or damaging to reputation.
4.4 Reviews
Providers may publish their Google reviews or reviews from other public websites. These must be truthful and factual and must not contain advertising, links, or personal data of third parties. Any manipulation of the review system, particularly purchased, fake, or self-written reviews, is prohibited. ChakraTribe may delete reviews that violate these rules or contact the review website.
5 Obligations of providers
5.1 Truthful and complete information
Providers must provide truthful, complete, and non-misleading information regarding their offerings, in particular concerning:
- - Program, content, location, dates, and duration
- - Included and excluded services (e.g., accommodation, meals, transfers, excursions)
- - Total price incl. VAT and all mandatory additional costs, as well as payment terms
- - Participation requirements, skill level, course language, and maximum group size
- - Cancellation and withdrawal policies (mandatory)
- - Qualifications of the lead personnel
-
The offer description becomes part of the contract between the provider and the participant.
5.2 Qualifications, Permits, and Insurance
Providers possess the necessary qualifications and permits for their offer and comply with the regulations applicable at the location of implementation, particularly regarding safety, hygiene, accommodation, and work permits. They maintain adequate liability insurance. ChakraTribe may request corresponding proof.
5.3 Legal Obligations towards Participants
Providers are solely responsible for fulfilling the legal obligations applicable to their offers. These include, in particular:
- Information obligations towards consumers, including any required notification regarding a statutory right of withdrawal (Section 7.6)
- Obligations under package travel law if an offer combines multiple travel services (e.g., accommodation and transport), including any necessary insolvency protection
- Taxes and duties, in particular value-added tax and tourist taxes, on the revenue generated with their offers
5.4 Prohibited Content
In particular, offers and content that violate legal regulations or public policy, as well as impermissible health or efficacy claims, are prohibited. Offers must not give the impression that they replace medical, psychotherapeutic, or other medical treatment, unless the providers possess the appropriate authorization.
5.5 Links and Advertising
Links to external websites are only permitted in the designated fields of the provider profile. Offers must not contain advertising for services that are not the subject of the respective offer.
5.6 Intellectual Property Rights
All rights to the platform (e.g., copyright and trademark rights) are held by ChakraTribe. To the extent required for contractual use, providers are granted a personal, non-exclusive, and non-transferable right of use for the duration of the contractual relationship.
Texts, images, videos, and other content published by providers ("Provider Content") remain the property of the providers. Providers confirm that they hold all rights to this content, including the consent of any persons depicted, and that no third-party rights are infringed. This applies in particular to content that is publicly accessible elsewhere.
Providers grant ChakraTribe the following rights to provider content free of charge:
- - all usage rights that ChakraTribe requires to provide its services, e.g., reproduction, storage, adaptation, translation, and publication
- - the right to use the content to promote the platform (e.g., online, social media, print, and trade fair advertising) during use on the platform and for up to one year thereafter
- - the right to use the content for analysis and further development of the platform
6 Subscription and Fees
6.1 No Commission
ChakraTribe does not charge a commission on bookings. Use of the platform is free of charge for participants.
6.2 Subscription
Providers pay a monthly subscription fee to publish offers. The amount and scope of services for the subscriptions are based on the current price list and are displayed before completion.
6.3 Term and Cancellation
The subscription runs on a monthly basis and automatically renews for another month at a time. It can be cancelled at any time effective at the end of the current billing period via the provider account or by sending an email to info@chakratribe.one. Upon expiration of the subscription, offers will be deactivated. Already confirmed bookings remain unaffected.
6.4 Payment
The subscription fee is due in advance at the beginning of each billing period. The following payment methods are available: credit card (Visa, Mastercard), TWINT, and E-Banking/SEPA. A VAT-compliant receipt will be available for download in the provider account after payment.
In the event of late payment, providers will receive a payment reminder via email. Starting with the first reminder, ChakraTribe may charge a late fee of EUR 10.00. If outstanding amounts are not paid within 30 days of the due date, offers will be deactivated. In the event of continued non-payment, the account may be suspended and the outstanding balance referred to a collection agency.
6.5 Refunds
Subscription fees already paid will not be refunded, in whole or in part, in the event of cancellation or deactivation of offers due to violations of the Terms and Conditions. If ChakraTribe closes an account through no fault of the provider, the fee for the remaining unused term will be refunded on a pro-rata basis.
6.6 Price changes
ChakraTribe may adjust prices. Providers will be notified at least 30 days before the changes take effect and may terminate their subscription at that time.
6.7 Additional services
Providers may use paid additional services, such as highlights or advertising packages. Such paid placements are identified as such on the platform. Fees for additional services are non-refundable, even if the listing is deleted by the providers themselves or due to a violation of the terms and conditions.
6.8 Value Added Tax
All prices are in EUR and include statutory VAT.
6.9 Prohibition of circumvention
It is prohibited to circumvent ChakraTribe's fee structure, for example by sharing a provider account among multiple independent providers.
7 Relationship between providers and participants
7.1 General
ChakraTribe assumes no liability for the fulfillment of contractual obligations by providers and participants.
7.2 Conclusion of contract
Depending on the listing, the booking is made as:
- Instant booking: The contract is concluded upon completion of the booking on the provider's website.
- Booking request: The contract is only concluded once the provider confirms the request.
The specific type is indicated in the listing. By publishing a listing for instant booking, providers are making a binding offer. Providers may delete listings at any time. Confirmed bookings remain binding.
7.3 Contract Content and Payment
The content of the contract is determined by the offer description, the provider's terms and conditions at the time of booking, and any other agreements. Payment is made directly to the provider in accordance with their payment terms. ChakraTribe does not accept payments for bookings. Providers may not pass on the costs of their ChakraTribe subscription to participants as an additional fee.
7.4 Cancellation by Participants
The cancellation policies specified by the provider in the offer apply. ChakraTribe recommends that participants take out cancellation or travel insurance for retreats and trips.
7.5 Cancellation by Providers
If providers cancel an offer, they must fully refund any payments already made within 14 days, unless otherwise agreed. Further legal claims by participants remain unaffected. No claims may be made against ChakraTribe.
7.6 Right of Withdrawal
Under Swiss law, there is no general right of withdrawal for the services offered here. A statutory right of withdrawal may exist for consumers residing in the EU, particularly in Germany. This is generally excluded for leisure events with a fixed date, but often applicable to online courses. Providers are responsible for providing correct information regarding any potential right of withdrawal.
7.7 Health and Personal Responsibility
Participants are responsible for ensuring that their state of health allows them to participate. They must inform providers in advance of any relevant health restrictions, pregnancy, or similar conditions and clarify any concerns with a doctor. These offers are not a substitute for medical or therapeutic treatment.
For offers located abroad, participants are responsible for their own travel arrangements, travel documents, visas, vaccinations, and insurance, unless otherwise stated.
7.8 Complaints
Any complaints regarding the execution of an offer must be addressed directly to the provider without delay. The contractual agreements and mandatory legal provisions apply.
8 Platform Operation
8.1 Prohibited Listings and Deletion
ChakraTribe may exclude certain types of listings and delete or deactivate any content that violates these Terms and Conditions or applicable law, is assigned to an incorrect category, or is clearly not intended to be serious. Providers will be informed of the reasons and given the opportunity to respond (Section 8.4).
8.2 Categories
ChakraTribe reserves the right to rename, merge, split, discontinue, or introduce new categories at any time and to move listings accordingly.
8.3 Reporting unlawful content
Anyone may report content they believe to be unlawful or in violation of the GTC via info@chakratribe.one. ChakraTribe reviews reports promptly and informs the reporting party of the outcome.
8.4 Complaints
Providers may lodge a complaint against decisions made by ChakraTribe (e.g., deletion, blocking, termination) within 30 days by emailing info@chakratribe.one. ChakraTribe will review the complaint and communicate the outcome.
8.5 Ranking of offers
The order of offers in search results and overviews is primarily based on recency, date, relevance to the search query, region, category, and country. Paid highlights (Section 6.7) are clearly marked.
8.6 Warning
ChakraTribe may issue warnings to users if there is credible, concrete evidence of a breach of the GTC or a willful violation of contractual obligations towards other users. The right to block or terminate (Section 3.4) remains reserved.
8.7 Mobile devices
ChakraTribe may enable the use of the platform on mobile devices, exclude individual functions, and technically adapt content for mobile display. Bookings made via mobile devices are just as binding as those made via the website.
9 Data protection
ChakraTribe processes personal data in accordance with the privacy policy.
10 Transfer of rights and obligations
ChakraTribe may transfer individual or all rights and obligations from these GTC to third parties. Users may not transfer their rights and obligations.
11 Liability
11.1 General
ChakraTribe is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. In cases of slight negligence, ChakraTribe is only liable for the breach of essential obligations that enable the use of the platform and upon which users may rely, limited to foreseeable, typical damages. Otherwise, liability is excluded to the extent permitted by law. Mandatory legal provisions remain reserved.
11.2 Offers and Execution
ChakraTribe assumes no responsibility for the accuracy of offers, qualification details, or reviews. Furthermore, ChakraTribe is not responsible for the quality, safety, legality, availability, or execution of offers, for the fulfillment of contracts between providers and participants, or for damages arising during participation in an offer. The same applies to the accuracy of automatic translations.
11.3 Technical Disruptions and Maintenance
The platform may be temporarily unavailable or limited due to maintenance work or other reasons. There is no entitlement to uninterrupted availability. Liability is governed by Section 11.1.
11.4 Users and Third Parties
ChakraTribe is not liable for damages resulting from the conduct of users or third parties in connection with the platform.
11.5 Linked Websites
ChakraTribe assumes no liability for the content of external websites accessible via links on the platform.
12 Indemnification
If third parties assert claims against ChakraTribe due to content or offers provided by users or due to their use of the platform, the respective users shall indemnify ChakraTribe against all such claims. They shall also bear the costs of legal defense, including court and attorney fees.
13 Severability Clause
Should individual provisions of these Terms and Conditions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to its economic purpose. The same applies to any regulatory gaps.
14 Applicable Law and Place of Jurisdiction
These Terms and Conditions and all related disputes are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Aadorf, Switzerland. For consumers, mandatory places of jurisdiction and mandatory protective provisions of the law at their place of residence remain reserved.
